The FPRC (Family Procedure Rule Committee has launched a stakeholder consultation on making the general enforcement application procedure more effective when it comes to the enforcement of family financial orders. The consultation will end on 28 August 2020
It follows a report by the Law Commission in December 2016 on the enforcement of family financial orders. Some of its recommendations focus on making the general enforcement application procedure as clear and effective as possible.
The FPRC accepts that the procedure could be improved and enforcement made easier to understand and access with some minor changes to the Family Procedure Rules 2010 (FPR 2010).
The FPRC’s working group believes that the following reforms should be prioritised:
*undertaking a limited transposition of some provisions from the Civil Procedure Rules 1998 to the FPR 2010, so that the key rules for enforcement in family proceedings are all in one place
*realising this by amendments to FPR 2010, SI 2010/2955, Pt 33 which is dedicated to enforcement
*removing any procedural ambiguities or gaps in the current rules and promoting uniform practice across courts through building into FPR 2010, SI 2010/2955, Pt 33 detailed procedure for the general enforcement application
The consultation aims to take views on how best to pursue these targeted reforms. It invites respondents to provide views and insight on any aspect of the proposals, limited to the reforms in question.
Further reform may be introduced at a later date, however, the current focus is on making the general enforcement application procedure as effective as possible.
