How Does Family Mediation Work?

People are often referred to a Mediator by their Solicitor and may already have received legal advice. However, this is not necessary and you can, if you wish, contact us without having consulted a Solicitor first.

The mediation process starts with a brief assessment meeting between the Mediator and each party to the mediation, individually. This usually lasts approximately 15 minutes and may be done over the telephone. This is to assess the suitability of the case for mediation. It is entirely the decision of the Mediator to determine the suitability or otherwise of a case for mediation. In the event that a case is determined to be unsuitable, the Mediator may elect to give no reasons for the decision in this regard.

Assuming the case is deemed suitable by the Mediator, the first mediation meeting would be arranged as soon as possible thereafter. Full mediation sessions usually last for about an hour and a half. The number of meetings required will vary from case to case.

If financial issues are being discussed, the process starts with the disclosure of all financial information. (It should be noted that such information may be referred to by either party in Court, should Court proceedings become necessary and can be used by either party’s Solicitor). The Mediator enables you to have open and honest discussions; ensures that both of you are fully involved and participating in the discussions and that any proposals for settlement are realistic.

The Mediator will also encourage you, where necessary, to seek legal advice from a Solicitor during and after the mediation process. In certain circumstances, the Mediator will recommend the involvement of other experts e.g. accountants and actuaries (to value pensions).

Once an agreement has been reached, the Mediator may prepare written summaries of your proposals and the financial information on which these are based. Your Solicitors will then be able to advise on these proposals and, where appropriate, will draft the documents that will be sent to the Court, enabling the terms agreed to be incorporated into a legally binding order.
