Personally, it is a term I dislike but it has become a “thing” and as such a bit of explanation would be good.
Statistics have shown how the first Monday after New Years Day finds family law solicitors receiving an influx of enquiries from potentially separating couples. As it is a severe spike in enquiries, it has become known as “Divorce Day”, or “Divorce Monday”.
Historically, if a couple were splitting up they would speak to a solicitor who would then handle the case for them and make a referral to a family mediator. This is because separating couples need to meet with a family mediator before court proceedings for child arrangements and/or financial matters can be issued.
However, we are increasingly finding couples are now approaching family mediators in the first instance and then referring to a solicitor is they need legal legal advice during the mediation process.
